Returns and shipping
We ship high-quality artworks and unique pieces. To ensure the safety of these delicate items, strict conditions apply to shipping and any returns. Please read them carefully.
1. Shipping & Delivery
Packaging & Security: Each artwork is carefully and professionally packaged by us to protect it from shocks and moisture. We use specialized shipping providers and insure the packages according to the value of the goods.
Delivery times: Because the secure packaging of artwork requires care, shipping does not always occur on the day of order placement. Preparation time is typically 3-5 business days. In addition, there is the transit time of the parcel service. In exceptional cases, shipping can take weeks or even months.
Customs & Taxes (International): For deliveries outside the EU (third countries), customs duties, import taxes, and fees may apply. These are not covered or charged by 22nd Gallery (represented by PE Art Capital UG (limited liability)) but must be paid directly by the buyer to the relevant customs or tax authorities. If the buyer refuses acceptance due to these costs, the return shipping costs will be deducted from the refund amount.
2. Transport damage
Inspection upon receipt: Artworks are delicate. Please inspect the package immediately upon delivery in the presence of the courier for external damage (dents, holes, moisture).
If the packaging is visibly damaged, refuse acceptance or have the damage confirmed in writing by the delivery person ("Accepted damaged").
Without this confirmation, transport insurance companies often refuse to settle claims. In this case, we cannot accept liability for damages resulting from transport.
Reporting: Any hidden damage must be reported to us immediately, but no later than 24 hours after receipt, in writing and with photographic documentation. Claims for transport damage made after this time cannot be accepted, as it is no longer possible to determine whether the damage occurred at the customer's premises or during transport.
3. Return Policy (Returns)
You have the legal right to withdraw from the contract within 14 days. To protect us and the artworks, the following regulations apply:
A. Return shipping costs: The buyer is solely responsible for all direct return shipping costs. Please note: Returning bulky artwork or framed pictures can be expensive (oversized items). We do not provide free return labels.
B. Risk of return: The buyer is responsible for ensuring that the goods arrive undamaged.
The artwork must be returned in its original packaging and with all protective materials.
If goods are returned inadequately packaged and arrive damaged, we are entitled to claim compensation for the loss in value . In the case of artworks, this can amount to up to 100% of the purchase price (total loss).
We strongly recommend adequately insuring the return shipment and keeping the tracking number.
C. Return procedure:
Registration: Returns must be announced in advance via email. We do not accept packages sent without postage; these will be returned to the sender at the sender's expense.
Condition: The artwork must show no signs of use beyond what is necessary to inspect the item (as is possible in a retail store). Traces of mounting, fingerprints on the canvas, or scratches on the frame will result in a deduction from the refund.
D. Exclusion of the right of withdrawal: The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for whose production an individual selection or specification by the consumer is decisive (e.g. custom work, specially made frames).
4. Compensation for value and special regulations (condition & processing)
Strict inspection upon return: As these are works of art, every return is subject to a strict incoming inspection (including under UV light) by our experts.

Even the smallest alterations (e.g. micro-scratches on the frame, fingerprints on the image surface, removal of protective films, damaged seals) mean that the work can no longer be sold as a "new original".

In this case, we reserve the right to retain compensation of up to 50% of the purchase price or – if the item is unsaleable – the full purchase price.
Restocking fee: Returns incur significant costs for us inspecting, repackaging, and restocking items. Therefore, we reserve the right to deduct a processing and restocking fee of 15% of the merchandise value (but at least €50.00) from the refund amount for returns not due to a defect.
Returns sent without postage: Returns sent to us "postage due" (without postage) or cash on delivery will not be accepted and will be returned to the sender at their expense. The risk of refusal of acceptance lies with the buyer.
